By reserving a charter or using our Service, you consent to comply with these Terms. Should you object to any section of these terms, then you are prohibited from using the Service.

2. Service Overview

StoneCoveTide offers high-end yacht charter services, including but not restricted to:

  • Yacht hire for a day
  • Twilight sea voyages
  • Business retreats
  • Exclusive gatherings
  • Extended yacht charters

Service availability is dependant on several factors and weather conditions. We retain the discretion to alter or cancel services at our discretion.

3. Booking and Reservations

3.1 Booking Process

For charter reservation, you are required to:

  • Be of a minimum age of 18 years
  • Submit precise and complete details
  • Make the necessary deposit as outlined in your booking confirmation
  • Adhere to these Terms & Conditions

3.2 Confirmation

Confirmation of your booking takes place only after we receive your payment and provide you with our written endorsement. We reserve the entitlement to decline service to anyone according to our judgment.

3.3 Availability

Charter reservations are contingent upon yacht availability and apt weather conditions. We will endeavor to fulfill your preferred dates and times to the best of our ability.

4. Payment Terms

4.1 Pricing

All charges are stated in € and encompass relevant taxes unless specified otherwise. Costs are liable to change without prior notification.

4.2 Payment Schedule

  • Deposit: 50% of the entire charter cost due upon reservation
  • Remaining payment: Due 48 hours preceding the charter's departure
  • Extra fees (if any): Payable upon charter completion

4.3 Payment Methods

We accept widely-used credit cards, electronic funds transfer, and certified drafts. Payment processing will be conducted using secure and encrypted procedures.

5. Cancellation and Refund Policy

5.1 Customer Cancellations

  • Exceeding 72 hours before departure: Entire refund excluding processing fees
  • Between 24 to 72 hours prior to departure: Refund of 50%
  • Less than 24 hours until departure: No refund

5.2 Weather Cancellations

Should our captain determine the weather as unsafe, we will propose to:

  • Move your charter to a subsequent available date without additional costs
  • Issue a complete refund if rescheduling is impractical

5.3 Mechanical Issues

In the scenario of mechanical faults with the assigned vessel, we will try to supply a comparable alternative. Should no alternative be obtainable, we will return the full payment.

6. Safety and Conduct

6.1 Safety Requirements

All guests must:

  • Comply with all crew directives
  • Don safety equipment when mandated
  • Announce any health conditions that might impact their safety
  • Stay within the designated regions of the vessel

6.2 Prohibited Items

The items listed below are forbidden on board:

  • Glass items
  • Illegal substances
  • Firearms or any type of weaponry
  • Excessive beverages (more than moderate consumption)
  • Pets (except with previous approval)

6.3 Conduct

Visitors are expected to behave respectfully. Should passenger conduct cause a risk to safety or disrupt other individuals' experiences, we reserve the right to conclude a charter prematurely without a refund.

7. Liability and Insurance

7.1 Our Liability

Our accountability is confined to the fee paid for your charter. We do not hold responsibility for:

  • Bodily harm resulting from guest negligence
  • Theft or damage to personal belongings
  • Indirect, incidental, or punitive losses
  • Delays due to meteorological conditions or events beyond our command

7.2 Insurance Coverage

Our insurance is comprehensive and includes our ships and operations. Passengers bear responsibility for their own travel and personal insurance needs.

7.3 Assumption of Risk

By partaking in our yacht charters, you recognize the inherent dangers associated with maritime activities and you accept responsibility for your own security and safety.

8. Modifications and Itinerary Changes

Itineraries, courses, or timetables may be altered due to weather challenges, security reasons, or operational demands. We shall strive to offer equivalent substitute experiences.

9. Force Majeure

No accountability is accepted for interruptions, cancellations, or changes brought about by unforeseen circumstances, such as but not limited to:

  • Extensive weather disturbances
  • Natural calamities
  • Regulatory enactments
  • Harbor closures
  • Equipment malfunctions

10. Privacy and Data Protection

Your private details are managed as per our Privacy Policy. By utilizing our services, you consent to the recording and utilization of your details as elaborated in our Privacy Policy.

11. Intellectual Property

The material on our website, which includes written content, visuals, trademarks, and photographs, is safeguarded by copyright and intellectual property laws. Unauthorized replication, dissemination, or creation of derivative materials is prohibited without our expressed authorization.

12. Governing Law

These Terms are subjected to the prevailing laws of France. Disagreements will be addressed in the court systems of Cannes, France.
